Terms of Service

• "Service" refers to the Favlista platform accessible at favlista.com
• "User", "you", or "your" refers to any person who accesses or uses the Service
• "Creator" refers to a User who creates and publishes Lists on the Service
• "List" refers to a curated collection of Products created by a Creator
• "Product" refers to an item linked within a List, including its title, URL, price, and image
• "We", "us", or "our" refers to Piotr Ciechowicz, operating as Favlista

To use our Services, you must: - Be at least 16 years of age - Have the legal capacity to enter into a binding agreement - Not be prohibited from using the Services under applicable laws By using our Services, you represent and warrant that you meet these eligibility requirements.

To access certain features of our Services, you must create an account. When creating an account, you agree to: - Provide accurate, current, and complete information - Maintain and promptly update your account information - Keep your password secure and confidential - Be responsible for all activities that occur under your account - Notify us immediately of any unauthorized use of your account We reserve the right to suspend or terminate accounts that violate these Terms.

Favlista is a platform that allows Creators to: - Create collections of products and links they recommend - Share these collections with their audience - Track engagement analytics (views, clicks) - Attach their own affiliate links, clearly labeled as such We provide the platform infrastructure but do not sell or endorse the products featured in Collections, and we do not issue affiliate links, calculate commissions, or pay out earnings.

• Create up to 3 collections
• Add up to 20 recommendations per collection
• Add up to 10 custom links
• Public page with basic analytics
• Own affiliate links with a visible label

Pro Plan ($7/month)

• Unlimited collections, recommendations and custom links
• Custom appearance (colors, type, spacing)
• SEO title and description overrides
• Hide the Favlista footer branding
• Extended analytics and CSV export

Billing

- Subscriptions are billed monthly in advance - Applicable taxes are calculated and added at checkout based on your location (managed via EU OSS) - Payments are processed securely through Stripe - You can cancel your subscription at any time - Upon cancellation, you retain access until the end of the billing period - No refunds for partial months

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day the contract was concluded. To exercise the right of withdrawal, you must inform us (Piotr Ciechowicz, Schmohlstr. 2, 13086 Berlin, Germany, hello@favlista.com) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post or email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.

Loss of Right of Withdrawal for Digital Content

You expressly agree that we begin the performance of the contract before the withdrawal period has expired. You acknowledge that you will lose your right of withdrawal once the digital content has been fully provided.

Ownership

You retain ownership of the content you create on Favlista, including Lists and Product descriptions. However, by posting content on the Service, you grant us certain rights as described below.

License to Favlista

By posting content on Favlista, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, display, and distribute your content in connection with operating and improving the Service. This license ends when you delete your content or account.

Prohibited Content

• Illegal products or services
• Counterfeit or stolen goods
• Adult content or explicit material
• Weapons, drugs, or controlled substances
• Hate speech or discriminatory content
• Malware, phishing, or deceptive content
• Content that infringes intellectual property rights
• Spam or misleading product information

The Service and its original content (excluding User Content), features, and functionality are owned by Favlista and are protected by international copyright, trademark, and other intellectual property laws. You may not: - Copy, modify, or distribute our Service - Use our branding without permission - Reverse engineer or attempt to extract source code - Remove any copyright or proprietary notices

Our Service contains links to third-party websites and products. We are not responsible for: - The content, accuracy, or opinions expressed on linked sites - The products or services offered by third parties - Any damages or losses arising from your use of linked sites We recommend reviewing the terms and privacy policies of any third-party sites you visit.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: - Merchantability or fitness for a particular purpose - Non-infringement of third-party rights - Uninterrupted or error-free operation - Accuracy or reliability of any information We do not endorse, guarantee, or assume responsibility for any products featured in Lists or any third-party content.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAVLISTA AND ITS OWNER SHALL NOT BE LIABLE FOR: - Any indirect, incidental, special, consequential, or punitive damages - Loss of profits, data, use, goodwill, or other intangible losses - Damages resulting from unauthorized access to your account - Damages resulting from third-party content or conduct Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Favlista, its owner, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from: - Your use of the Service - Your violation of these Terms - Your violation of any third-party rights - Content you post on the Service

We may terminate or suspend your account and access to the Service: - Immediately, without prior notice, for violations of these Terms - Upon your request to delete your account - If required by law or legal process Upon termination: - Your right to use the Service will cease immediately - We may delete your account and content - Provisions that should survive termination will remain in effect

We reserve the right to modify these Terms at any time. We will notify you of material changes by: - Posting the updated Terms on this page - Updating the "last updated" date - Sending an email notification for significant changes Your continued use of the Service after changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany. For EU consumers: Nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Favlista regarding the Service.
